I don't know all the nuances of their communications, so I will defer to you on that. As to the liability of the LLC (Limited Liability Corporation): Doubtful unless fraud can be proven. That would defeat the purpose of creating an LLC.
Another speed-bump for SNDD is that possible financial loss or expenses, claimed by a plaintiff, that are contingent upon a future occurrence, are classified as speculative damages. Courts generally do not award speculative damages to Plaintiffs suing under contract law.
